1. Acceptance of Terms
Welcome to Acadia. By creating an account, registering your school, or utilizing our software platform, you agree to comply with and be bound by these Terms and Conditions. These terms govern the relationship between your school ("the Customer"), its authorized staff, teachers, parents, and Acadia (a product of Kewry Studio).
2. Description of Service
Acadia provides a cloud-based school management platform designed to streamline school operations. The service includes, but is not limited to, tools for student and teacher records management, attendance tracking, school fee invoicing and payments, report card generation, and parent-school communication channels.
3. School Accounts & Security
To use Acadia, schools must register an administrative account. You are solely responsible for:
- Maintaining the confidentiality of account credentials and passwords.
- Restricting access to administrative and teacher portals to authorized personnel only.
- All activities, data uploads, and actions performed under your school's account.
- Ensuring that student data is uploaded with appropriate parental consent or educational authority.
4. Data Ownership & Intellectual Property
Your Data: The school retains absolute ownership of all intellectual property, student records, academic data, grades, and parent communication records uploaded to the platform. Acadia claims no ownership over your data.
Our Platform: Kewry Studio retains all right, title, and interest in and to the Acadia platform, including software, code, designs, branding, logos, graphics, and underlying infrastructure. You may not copy, modify, distribute, or reverse-engineer any part of our service.
5. Fees and Payment Terms
Certain features of the platform require a paid subscription. The school agrees to pay all fees associated with its selected plan according to the agreed billing cycle (monthly, termly, or annually). All fees are non-refundable unless explicitly stated otherwise. Acadia reserves the right to adjust subscription rates with at least 30 days prior notice to customers.
6. Acceptable Use
You agree not to use Acadia to:
- Upload, transmit, or store any content that is unlawful, harmful, threatening, abusive, defamatory, or violates privacy rights.
- Upload malicious code, viruses, or any software designed to disrupt or damage the platform's infrastructure.
- Impersonate any person or entity, or falsely state affiliation with a school or educational institution.
- Attempt to gain unauthorized access to other school accounts or data.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Acadia and Kewry Studio shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses resulting from the use or inability to use the platform.
8. Termination of Service
You may terminate your school's account at any time by contacting us. Acadia reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or fail to pay subscription fees. Upon termination, we will provide a grace period during which you may export your school's data.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Kumasi, Ghana.
